Other
Legal Work:
Following the horrific terrorist
attacks of September 11, 2001, and the subsequent
U.S. occupation of Afghanistan, Bashir became
a consultant for the International Development
Law Organization (IDLO), based in Rome where
he helped host a one-week long December 2002
Roundtable and Conference entitled, “The
Role of Law in a Modern Afghanistan. The
participants included legal experts from around
the world and Afghanistan.
In 2003, Bashir went to Afghanistan
to take part in the reform of Afghanistan’s
justice system, where he assisted in opening
a Kabul office for IDLO, which is a law development
organization with a background in providing
legal technical support and training to post
conflict governments.
Also
while in Kabul, as the only in-house foreign
consultant, Bashir assisted the Judicial Reform
Commission, which consisted of 11 members appointed
by President Karzai, in setting out a work plan
of activities to reform and revive the justice
system of Afghanistan. Bashir’s
work with the Judicial Reform Commission included
assisting in law reform, surveys, physical infrastructure
and training, legal education and awareness,
structuring the justice system, and internal
organization of the commission and its work.
In addition, Bashir served as an advisor to
the Minister of Justice.
In
November 2003, Bashir traveled to Geneva and
Afghanistan working as a Rule of Law and Justice
Reform Advisor with the Centre for Humanitarian
Dialogue on a short term mission to review how
assistance to the justice and the rule of law
sector in Afghanistant has been planned and
managed, and how blockages in delivery and implementation
might practically be eased. Bashir helped prepare
a report entitled, Practical
Review of Rule of Law and Justice Sector Assistance
to Afghanistan. [See Assistance to Justice and the Rule of Law in Afghanistan:
A strategic analysis, by The Centre for Humanitarian
Dialogue]
From
July 2005 to November 2006, Bashir worked as
a justice advisor with the State Department
where he accompanied a team of 7 other American
legal experts to Afghanistan and helped embark
and implement a multi-million dollar Rule of
Law Program by working closely with Afghan counterparts.
Due to his effectiveness and hard work, Bashir
soon became the U.S. Embassy’s sole embedded
advisor to Afghanistan Ministry of Justice,
where he worked on a range of reform efforts,
such as developing a 10 year strategy for the
justice sector and the ministry, legal awareness,
the establishment and promotion of a defense
attorneys’ bar, reform and legislation
of laws, and capacity building. This Program
has now grown in size and consists of dozens
of prosecutors and corrections experts
